Terms of Service

1. Introduction

These Terms of Service (the "Terms") govern your access to and use of the Tributly.io website, browser extension, software, dashboards, payout-related features, advertising-related features, and any related services (collectively, the "Service").

By accessing or using the Service, creating an account, installing the browser extension, or otherwise interacting with Tributly.io, you agree to be bound by these Terms. If you do not agree to these Terms, you must not use the Service.

2. Operator of the Service

The Service is operated by Cortallis Sp. z o.o., registered at Jana Kochanowskiego 31, Warsaw, Poland (the "Company", "Tributly.io", "we", "us", or "our").

This address is an administrative/private office address and is not a customer service location or storefront. Please do not visit this address without prior written appointment.

3. Eligibility

You may use the Service only if you are at least 18 years old and legally capable of entering into a binding agreement.

By using the Service, you represent and warrant that you meet these eligibility requirements and that your use of the Service complies with all applicable laws and regulations.

4. Description of the Service

Tributly.io provides a browser extension and related online services that may display advertisements and, where available, allow eligible users to earn rewards based on qualifying activity under conditions determined by Tributly.io.

The Service may include account features, ad display functionality, telemetry necessary to operate and verify the Service, fraud prevention systems, payout-related functionality, and related website features.

We may modify, suspend, discontinue, or restrict any part of the Service at any time, including features, eligibility criteria, payout mechanisms, reward logic, supported platforms, or availability in specific regions.

5. Account Registration and Security

Certain features may require you to create or access an account using supported authentication methods, such as email-based login or third-party authentication providers.

You are responsible for maintaining the confidentiality and security of your account credentials and for all activity that occurs under your account. You must promptly notify us if you suspect unauthorized access to your account.

You may not create, operate, control, or use multiple accounts to manipulate the Service, bypass restrictions, obtain additional rewards, or otherwise abuse the Service. We may merge, suspend, restrict, or terminate duplicate, suspicious, or fraudulent accounts.

6. License to Use the Service

Subject to your compliance with these Terms, we grant you a limited, revocable, non-exclusive, non-transferable, non-sublicensable license to install and use the browser extension and access the Service for your personal, lawful use.

This license does not transfer ownership of the Service or any intellectual property rights to you. We reserve all rights not expressly granted in these Terms.

7. Acceptable Use

You agree not to misuse the Service. In particular, you must not:

  • (a) use bots, scripts, automation, emulators, click farms, traffic exchanges, or other artificial methods to generate impressions, clicks, views, engagement, rewards, or payouts;
  • (b) manipulate, interfere with, obscure, bypass, or falsely trigger ad display, visibility, telemetry, payout, or fraud prevention systems;
  • (c) reverse engineer, decompile, disassemble, modify, tamper with, or attempt to extract the source code of any part of the Service, except where such restriction is prohibited by applicable law;
  • (d) exploit bugs, vulnerabilities, timing issues, or technical limitations of the Service;
  • (e) access or use the Service in a way that may damage, disable, overburden, or impair our systems or third-party systems;
  • (f) use the Service for unlawful, fraudulent, deceptive, harmful, or abusive purposes;
  • (g) impersonate any person or entity or misrepresent your affiliation with any person or entity;
  • (h) violate applicable advertising, platform, browser extension store, payment provider, data protection, consumer protection, tax, or other legal requirements;
  • (i) attempt to avoid suspension, enforcement action, account restrictions, payout holds, or geographic restrictions;
  • (j) interfere with the experience, security, or rights of other users, advertisers, partners, or service providers.

8. Advertising

The Service may display advertisements in supported contexts and surfaces. Ad availability, format, frequency, targeting, campaigns, advertisers, and technical delivery may vary over time.

You acknowledge that advertisements may be provided directly by us or through third-party advertisers, advertising partners, or service providers. We do not guarantee the availability, quality, relevance, duration, or frequency of any advertisement.

You may not artificially generate, inflate, manipulate, or simulate ad impressions, clicks, viewability, engagement, or any other advertising metric.

9. Rewards, Earnings and Payouts

Where rewards or earnings are available, they are subject to these Terms, eligibility rules, verification, fraud prevention checks, technical availability, advertiser demand, and any additional payout rules displayed in the Service.

We do not guarantee any amount, frequency, availability, continuity, or timing of rewards, earnings, or payouts. Past earnings do not guarantee future earnings.

Rewards may be calculated based on qualifying activity as determined by our systems. We may adjust, reverse, reject, delay, suspend, or withhold rewards or payouts if we reasonably suspect fraud, abuse, technical error, invalid traffic, breach of these Terms, breach of platform rules, or violation of applicable law.

Minimum payout thresholds, supported payout methods, payout schedules, identity verification requirements, tax information requirements, fees, currency conversion rules, and geographic availability may apply and may change over time.

Payouts may be processed by third-party payment providers, such as PayPal or other providers we may support. Your use of third-party payment services may be subject to their own terms, fees, verification procedures, restrictions, and policies.

You are solely responsible for any taxes, reporting obligations, duties, charges, or legal obligations arising from rewards, earnings, or payouts received through the Service, unless applicable law requires otherwise.

10. Fraud Prevention and Enforcement

We may monitor usage patterns, technical signals, account activity, ad events, device identifiers, payout activity, and other relevant information to detect fraud, abuse, invalid traffic, policy violations, and security risks, in accordance with our Privacy Policy.

If we believe that activity is fraudulent, abusive, invalid, unlawful, or in breach of these Terms, we may take one or more actions, including: suspending or terminating your account; restricting access to the Service; withholding, reversing, or forfeiting rewards; blocking devices, identifiers, accounts, or payment methods; reporting activity to relevant partners or authorities where appropriate; and taking legal action.

We are not required to disclose detailed fraud detection methods, risk signals, internal thresholds, investigation procedures, or enforcement logic if doing so could compromise the security or integrity of the Service.

11. Third-Party Services and Platforms

The Service may depend on or interact with third-party services, including authentication providers, cloud hosting providers, analytics tools, payment processors, browser extension stores, advertisers, and other technology providers.

We are not responsible for third-party services, websites, platforms, policies, outages, decisions, fees, verification procedures, account restrictions, or content. Your use of third-party services may be governed by separate terms and privacy policies.

You must comply with all applicable third-party platform rules, including browser extension store policies and payment provider rules.

12. Privacy and Cookies

Our processing of personal data is described in our Privacy Policy and Cookies Policy. These documents explain what data we collect, how we use it, how cookies and similar technologies are used, and what rights users may have under applicable data protection laws.

By using the Service, you acknowledge that your personal data will be processed as described in our Privacy Policy and Cookies Policy.

13. Intellectual Property

The Service, including software, source code, design, user interface, documentation, trademarks, logos, business methods, ad delivery systems, fraud prevention systems, content, and related materials, is owned by Tributly.io or its licensors and is protected by intellectual property and other laws.

You may not copy, modify, distribute, sell, lease, sublicense, publicly display, publicly perform, create derivative works from, or otherwise exploit any part of the Service except as expressly permitted by these Terms or applicable law.

The name "Tributly.io", related branding, logos, product names, and trade dress may not be used without our prior written permission.

14. User Feedback

If you provide suggestions, ideas, feedback, bug reports, or other comments about the Service, you grant us a worldwide, perpetual, irrevocable, royalty-free license to use, reproduce, modify, publish, distribute, and otherwise exploit such feedback for any lawful purpose without compensation to you.

15. Service Availability and Changes

We aim to provide a reliable Service, but we do not guarantee that the Service will be uninterrupted, secure, error-free, compatible with all devices or applications, or available at all times.

We may release updates, patches, new features, or changes to the browser extension or website. Some updates may be required for continued use of the Service.

We may suspend, limit, or discontinue the Service, in whole or in part, at any time, including for maintenance, security, legal, business, platform, or technical reasons.

16. Suspension and Termination

We may suspend, restrict, or terminate your access to the Service at any time if we reasonably believe that you have violated these Terms, applicable laws, platform rules, payment provider rules, or the rights of others, or if your use creates legal, security, fraud, reputational, operational, or technical risk.

You may stop using the Service at any time and may request account deletion as described in our Privacy Policy.

Upon termination, your license to use the Service ends immediately. Sections that by their nature should survive termination will continue to apply, including provisions relating to intellectual property, acceptable use, fraud prevention, rewards and payouts, disclaimers, limitation of liability, indemnity, governing law, dispute resolution, and privacy-related acknowledgements.

17. Disclaimers

The Service is provided on an "as is" and "as available" basis. To the maximum extent permitted by applicable law, we disclaim all warranties, whether express, implied, statutory, or otherwise, including warranties of merchantability, fitness for a particular purpose, title, non-infringement, accuracy, availability, security, and reliability.

We do not warrant that the Service will meet your expectations, generate any particular earnings, remain available, be compatible with your environment, or be free from errors, interruptions, vulnerabilities, or harmful components.

18. Limitation of Liability

To the maximum extent permitted by applicable law, Tributly.io and its directors, officers, employees, contractors, affiliates, partners, and licensors shall not be liable for any indirect, incidental, special, consequential, exemplary, punitive, or similar damages, including loss of profits, loss of revenue, loss of data, loss of goodwill, business interruption, or loss of expected earnings, even if we have been advised of the possibility of such damages.

To the maximum extent permitted by applicable law, our total aggregate liability arising out of or relating to the Service or these Terms shall not exceed the greater of: (a) the total amount actually paid by us to you through the Service during the twelve (12) months before the event giving rise to the claim; or (b) EUR 100.

Nothing in these Terms limits or excludes liability where such limitation or exclusion is prohibited by applicable law, including liability for intentional misconduct, gross negligence where applicable, or mandatory consumer rights.

19. Indemnity

To the maximum extent permitted by applicable law, you agree to indemnify and hold harmless Tributly.io and its directors, officers, employees, contractors, affiliates, partners, and licensors from and against any claims, losses, liabilities, damages, costs, and expenses, including reasonable legal fees, arising from or related to: your use or misuse of the Service; your breach of these Terms; your violation of applicable law or third-party rights; fraudulent or abusive activity; or your violation of platform, advertiser, or payment provider rules.

This section applies only to the extent permitted by applicable consumer protection laws.

20. Consumer Rights

Nothing in these Terms limits, excludes, or restricts any mandatory rights you may have under applicable consumer protection laws, including laws of your country of residence where such laws apply.

If any provision of these Terms is found to be unenforceable against a consumer, the remaining provisions will continue to apply to the maximum extent permitted by law.

21. Changes to These Terms

We may update these Terms from time to time. If we make material changes, we will take reasonable steps to notify users, such as by posting the updated Terms on our website, providing notice through the Service, or sending an email where appropriate.

The "Last updated" date at the top of these Terms indicates when they were last revised. Continued use of the Service after updated Terms become effective constitutes acceptance of the updated Terms, unless applicable law requires a different mechanism.

22. Governing Law and Jurisdiction

These Terms are governed by the laws of Poland, without regard to conflict of law principles.

You agree that disputes will be resolved in the competent courts of Poland, except where mandatory laws of your country of residence provide otherwise.

Nothing in these Terms shall limit any rights you may have under applicable consumer protection laws.

23. Assignment

You may not assign or transfer your rights or obligations under these Terms without our prior written consent.

We may assign or transfer our rights and obligations under these Terms in connection with a merger, acquisition, corporate reorganization, sale of assets, change of control, or by operation of law, provided that such transfer does not unlawfully reduce your mandatory rights.

24. Severability

If any provision of these Terms is held to be invalid, illegal, or unenforceable, the remaining provisions will remain in full force and effect. The invalid, illegal, or unenforceable provision will be replaced or interpreted to achieve, as closely as possible, the original purpose of that provision in a lawful manner.

25. No Waiver

Our failure to enforce any provision of these Terms does not constitute a waiver of that provision or any other provision. Any waiver must be in writing and signed by us.

26. Entire Agreement

These Terms, together with the Privacy Policy, Cookies Policy, and any additional rules or policies expressly incorporated by reference, constitute the entire agreement between you and Tributly.io regarding the Service and supersede any prior or contemporaneous understandings relating to the Service.
